Terms and conditions of sale

VAT not applicable, article 293 B of the French General Tax Code: prices are net, without VAT.
2. What these terms cover
They apply to FunnyMembers cards (FunnyCards), free or paid, which give access to FunnyDarts online services, including the Lhobby (playing online from one board to another).
The FunnyDarts application itself, the basic Offline version, remains free and is not sold: these terms only concern it because the Lhobby works with it.
The Lhobby Rules are part of these terms.
The Attract Mode is FunnyDarts’ modern screensaver: when nobody is playing, it shows the games, what’s new and your podiums. When the board is connected to the Internet, it may also show messages from FunnyDarts: release notes and ads dedicated to the sport of darts. These ads can be turned off in Configuration › Animation; release notes are still shown. These messages are text only, with no link or content from elsewhere; each display is counted anonymously (board identifier).
3. The cards and their prices

An access day starts at 6:00 am and ends at 5:59 am the next day. The next day starts at 6:00 am. Sessions after midnight, for example at 1 or 2 am, therefore belong to the access day started the evening before.

In version 1.3, only the IdCard and Bronze cards are offered; the others will be from version 1.5.
4. Before taking a card
By taking a card, you confirm:
- that you have run the functional test and found it satisfactory, for paid cards: a game of 301 against our server’s “FunnyTest” player, from the Offline version, which checks your installation’s connection (router, firewall, antivirus, cameras or board); you are the one who validates the result;
- that your FunnyDarts setup works with your system (application downloaded from funnydarts.fr, detection, cameras or board, computer, network);
- that you no longer use 📱 FunnyPad, which is not accepted in the Lhobby;
- that you have a stable, decent Internet connection;
- that you accept the Rules without reservation.
You undertake to use the latest available version of FunnyDarts, downloaded from funnydarts.fr.
You undertake not to modify this installation, either directly (deleting or changing an application file…) or indirectly (changing or updating the operating system, antivirus, firewall, hardware…).
If such a change prevents the Lhobby from working, FunnyDarts cannot be held responsible, and there is neither refund nor extension.
Updates of FunnyDarts itself, downloaded from funnydarts.fr, are not considered a change to your installation within the meaning of this exclusion.
Personal cards (Bronze, Founders, Day, Silver, Gold) are reserved for personal use, at home, on one installation, with one Lhobby open at a time.
5. Ordering and payment
Payment is made online by PayPal, on funnydarts.fr. The price to pay is shown before payment. The card is sent to your e-mail address as soon as payment is confirmed.
For monthly cards (Silver, Platinium), you choose 1 to 6 months, paid at once: the chosen duration and the total price are shown before payment.
No automatic debit: to continue, you renew your card yourself on the website (card choice, “Renewal” option, your card number), before or after it expires.
Platinium’s free month stops on its own: nothing is charged afterwards without your action.
6. Right of withdrawal (consumers)
To use your card right away, you request it by ticking a box when purchasing.
You can then withdraw within 14 days of purchase, without giving a reason, by express request by e-mail to support@funnydarts.fr, as long as you have not played in the Lhobby for more than 5 days in a row.
The refund covers months not yet started: each month not started is refunded at the price paid divided by the number of months purchased (12 for an annual card); for the Day card, days not yet started.
It is made within 14 days, via PayPal.
These terms do not reduce the rights the law gives you: if it gives you more, the law applies.
7. Price guarantee
Prices are based on simulations made today and may change.
The only guarantee, and it will be kept: as long as your subscription is not interrupted, you keep its starting price.
There is an interruption when the renewal is not made:
- within 7 days after expiry for a monthly card (Silver, Platinium);
- within 20 days after expiry for an annual card (Gold).
When renewing on the website, if you are within the deadline, the price asked is automatically that of your original subscription; beyond it, the current displayed price applies.
Current prices are always those displayed on funnydarts.fr.
8. What FunnyDarts undertakes to do
Access to the service
FunnyDarts’ only commitment: to let your installation access its online database, which connects players (cards, scores, Lhobby), for the duration of your card, subject to the interruptions described below.
How the Lhobby works at your place depends on your installation: it has been through a connectivity test that you validated, and you have undertaken not to modify it (article 4).
A change to your installation or network after this test is not FunnyDarts’ responsibility. If in doubt, you can run the test again at any time.
Our servers are monitored at all times: an outage on our side is recorded, which is what allows your card to be extended under the conditions below.
Maintenance and urgent interventions
Monday is a possible maintenance day, in particular to deploy major updates and run the necessary tests. It is not a systematic closure every Monday.
Planned interventions are preferably carried out in the morning. As far as possible, FunnyDarts avoids busy periods, in particular evenings after 5 pm and weekends. This organisation is not a guarantee of timing.
Urgent interventions may however take place at any time, in particular for an urgent deployment or a security intervention, including after an attack on the server.
No notice is guaranteed. During maintenance, a window shows the message “Maintenance in progress”.
On Mondays before 5 pm, service interruptions are excluded from compensation, including outages, urgent interventions and regressions linked to maintenance. From 5 pm on Mondays, the compensation rules below apply.
Waiting list
The waiting list is a safeguard that kicks in when the infrastructure reaches a critical number of players, to regulate traffic.
A player threshold is set: when the Lhobby reaches it, a new player waits for a place to free up before entering.
If this lock kicks in regularly, the infrastructure is improved.
Unfortunately the waiting list cannot be considered an outage; however, if the impact is significant, FunnyDarts offers extra days to the players concerned.
Interruption on our side and compensation
For the paid cards concerned, an outage or intervention on FunnyDarts’ side gives the right to an extension when it causes more than one hour of continuous interruption and affected you, that is, when your board tried to connect during this interruption.
An interruption of exactly one hour does not trigger compensation. Separate interruptions are not added together to reach the threshold.
On Mondays, counting starts at 5 pm. If an interruption started earlier, only its duration from 5 pm is taken into account.
A single access day counts for at most one affected day, even if several interruptions each exceed one hour during that day. This cap applies to the access day running from 6:00 am to 5:59 am the next day.
Each affected day meeting these conditions entitles you to:
- one extra access day for the private individuals’ paid cards concerned;
- two extra access days for Platinium cards.
For Emerald cards, the compensation terms are those of the accepted quote.
Free cards do not give rise to a refund.
Things outside our responsibility
FunnyDarts is not responsible for your Internet connection, your network, your router, your computer, your cameras or your board.
9. Stopping your card
Simply don’t renew: the card stops by itself on its expiry date, with no fees or formalities.
If the Lhobby were to be shut down for good, it would be announced on funnydarts.fr, and the months of your card not yet started would be refunded:
- price paid divided by the number of months purchased, per month not started (12 for an annual card);
- days not yet started for the Day card.
10. Breach of the Rules
In the event of a serious breach of the Rules (cheating, insulting behaviour, identity theft…), access to the Lhobby may be suspended, following the Rules procedure (reports from several different players), for an increasingly long period in case of repeat offences (levels set out in the Rules).
An appeal is always possible by e-mail.
A confirmed exclusion gives rise to neither refund nor extension.
11. Businesses (Platinium, Emerald)
These cards are reserved for establishments open to the public (bars, campsites, clubs, leisure centres) and event organisers, who have tested FunnyDarts and set it up themselves.
An RCS number and an e-mail address on the establishment’s domain name are required.
Platinium allows the use of FunnyDarts and the Lhobby on the premises, for its customers, with 1 to 5 Lhobby open at the same time.
Compensation for affected days is doubled for Platinium under the terms of article 8.
Terms specific to Emerald are set out in the accepted quote.
The right of withdrawal does not apply to professionals.
12. Personal data
See the Personal data page: only useful data is kept (e-mail, nickname, emoji, scores), never sold.
13. Where to find information
All information (prices, maintenance, new versions of these terms and of the Rules) is published on funnydarts.fr.
E-mails or alerts FunnyDarts may send are a bonus, not a commitment: remember to check the website, and check your spam folder.
Interventions may take place without notice, in accordance with article 8.
14. Mediation and disputes
If there is a problem, first write to support@funnydarts.fr: we will find a solution.
You will also be able to use a consumer mediator free of charge: they will be specified here as soon as the first paid offers are available.
These terms are governed by French law; if you live in another European Union country, you keep the protections your country’s law gives you.
